1. Agreement to terms
These Terms of Service (“Terms”) form a binding agreement between you and Blue Bridge Technology Services FZCO (“Blue Bridge”, “Qisto”, “we”, “us” or “our”), governing your access to and use of the Qisto mobile application, our website at qistoapp.com, and any related services (together, the “Services”).
By creating an account, downloading our app, or otherwise using the Services, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
To use the Services you must:
- be at least 18 years of age;
- be a resident of a country where we offer the Services;
- have the legal capacity to enter into a binding contract; and
- not be barred from using the Services under any applicable law (including sanctions and AML laws).
3. Your account
You will need to register an account and complete identity verification (KYC) to use most features of the Services. You agree to:
- provide accurate, current and complete information, and keep it updated;
- keep your PIN, password and device secure, and not share them with anyone;
- be responsible for all activity that takes place under your account;
- notify us immediately at support@qistoapp.com if you suspect any unauthorised use of your account.
We may refuse, suspend or close an account if information provided is inaccurate, if we cannot complete identity verification, or if continued use would breach these Terms or applicable law.
4. The Services
Qisto helps you discover partner merchants and, where eligible, finance purchases through instalment payment plans offered by Blue Bridge. The Services may also include account management, customer-support messaging, and related features.
Specific terms, limits, plans, fees and merchant offers are presented to you at the time of each purchase. By confirming a purchase in the app, you agree to those specific terms in addition to these general Terms.
5. Purchases & instalments
When you make an eligible purchase with a partner merchant:
- We display the total amount, down-payment, financed amount, and the full instalment schedule before you confirm.
- You confirm the purchase using your PIN. Confirmation authorises us to deduct the financed amount from your available credit and to bill you according to the schedule shown.
- We do not charge interest. Where a flat, transparent fee applies (for example, a late fee), it will be disclosed in advance.
- Down-payments are paid by you directly to the merchant at the point of sale, in cash or by any payment method the merchant accepts.
Your credit limit, tier and plan options depend on your account history and are determined at our discretion in line with applicable rules.
6. Repayments & late fees
You agree to repay each instalment by its due date according to the schedule shown to you at purchase. You can review your schedule, due dates and outstanding balance at any time inside the app.
6.1 How to pay
You may pay by the methods we make available in the app (bank transfer to our designated account, the monthly bill reference shown for your account, or other methods we add over time). Please use the exact reference shown so that we can match your payment to your account.
6.2 Late fees
If an instalment is not paid by its due date, a flat, non-compounding late fee may be charged in accordance with the rate disclosed in the app at the time of purchase, and subject to any caps required by applicable law. Late fees are not interest. Repeated non-payment may also result in account suspension, restriction of new purchases, and reporting to credit-information services where permitted.
6.3 Early repayment
You may repay any outstanding instalment early at any time without penalty. Early repayment reduces your outstanding balance and increases your available credit.
7. WhatsApp & messaging
By providing your phone number and using the Services, you agree to receive messages from us via WhatsApp (operated using the WhatsApp Business Platform from WhatsApp Ireland Limited, a Meta company), SMS, push notifications and email, including:
- one-time passwords (OTPs) and security codes;
- account, security and service notices;
- payment reminders, instalment notices and receipts;
- responses to customer-support messages you initiate; and
- if you have opted in: promotional updates about Qisto offers and partner deals.
You can opt out of non-essential messages at any time by replying STOP in WhatsApp, by adjusting your in-app notification settings, or by emailing privacy@qistoapp.com. Note that certain transactional messages (such as OTPs and overdue-payment notices) are required for the Services to function and cannot be disabled while you maintain an active account.
Our use of WhatsApp complies with Meta’s WhatsApp Business Messaging Policy and WhatsApp Commerce Policy. Messages routed through WhatsApp are also subject to WhatsApp’s privacy practices. See our Privacy Policy for more.
8. Acceptable use
You agree not to:
- use the Services for any unlawful, fraudulent, or harmful purpose;
- impersonate another person or misrepresent your identity;
- attempt to bypass security, rate-limits or authentication, or to access another user’s account;
- reverse-engineer, decompile or extract source code from our apps or systems, except as permitted by law;
- scrape, harvest or extract data from the Services without our written permission;
- interfere with the operation of the Services or with other users’ enjoyment of them;
- use the Services in violation of any applicable export-control, sanctions or anti-money-laundering law.
9. Intellectual property
The Services and all related content, software, designs, trademarks (including the names “Qisto” and “Blue Bridge”) and logos are owned by Blue Bridge or its licensors and are protected by applicable laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial purposes. All other rights are reserved.
10. Privacy
Our collection and use of your personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
11. Third-party services & merchants
The Services let you discover and transact with independent partner merchants. Each merchant is responsible for its own goods, services, pricing, refunds and returns. We are not a party to the underlying sale and do not warrant the quality, safety or legality of goods or services offered by merchants. Disputes about a purchase should first be raised with the merchant; we will assist where reasonable.
The Services may also include or link to third-party services (such as WhatsApp, payment processors and identity-verification providers). Your use of those services is subject to their own terms and policies, which we do not control.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure, or error-free. We do not warrant the accuracy or completeness of any information shown by merchants or third parties.
13. Limitation of liability
To the maximum extent permitted by applicable law, neither Blue Bridge nor its affiliates, officers, employees, agents, or licensors will be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, business or goodwill, arising out of or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States dollars (US $100). Nothing in these Terms limits liability that cannot lawfully be limited (including for fraud, gross negligence, or wilful misconduct).
14. Indemnification
You agree to indemnify and hold harmless Blue Bridge and its affiliates, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms or any applicable law; (b) your misuse of the Services; or (c) your infringement of any third-party rights.
15. Suspension & termination
You may stop using the Services at any time. You may also request closure of your account by emailing support@qistoapp.com, subject to settling any outstanding balance and to our retention obligations described in the Privacy Policy.
We may suspend or terminate your access to the Services, in whole or in part, with or without notice, where we reasonably believe that you have breached these Terms or any applicable law, that your continued use creates risk to you, other users, or to us, or where we are required to do so by law. Sections that by their nature should survive termination (including sections 9, 10, 12, 13, 14 and 17) will continue to apply.
16. Changes to the Services or Terms
We may modify the Services at any time, including adding, removing or changing features. We may also update these Terms from time to time. The “Last updated” date at the top of this page shows when the Terms were last revised. Material changes will be communicated through the app, by email, or by prominent notice on this page. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
17. Governing law & disputes
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws rules. The courts of Dubai shall have non-exclusive jurisdiction to settle any dispute, save where mandatory consumer-protection rules in your country of residence give you rights to bring proceedings before your local courts.
18. General
- Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and us with respect to the Services and supersede any prior agreements.
- Severability: if any provision is held to be unenforceable, the remaining provisions remain in full force.
- No waiver: our failure to enforce any right is not a waiver of that right.
- Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
